What is Probate?

Probate is the legal process of settling a loved one’s estate: validating the will if one exists, appointing someone to manage it, paying debts and taxes, and getting assets to the right people. It’s an important process, but it can also feel slow and overwhelming, especially if this is your first time dealing with it.

If you’re here because you can’t sell a house, the bank won’t release an account, or you’ve just been told you’re the executor, you’re in the right place. And if you’re in Indiana, keep in mind that state law requires an estate’s Personal Representative (Executor) to be represented by an attorney at all times in probate court.

Why Probate Matters

Probate helps:

HOW DO YOU KNOW WHEN PROBATE IS REQUIRED

Not every estate requires probate.

In some cases, assets can pass directly through joint ownership or named beneficiaries, such as bank accounts and retirement accounts. However, when probate is required, having legal guidance can make the process significantly smoother.

We can tell you whether you need to open an estate in probate court or if there is a quicker, easier alternative.
